When you need to estimate litigation costs, the rules for calculating court filing fees can often be complex and difficult to understand. This tool strictly follows Decree No. 481 of the Measures on the Payment of Litigation Costs, using a progressive bracket algorithm to automatically calculate filing fees for 6 types of disputes, including property and non-property cases. The case filing fee is defined as the official fee legally charged to the parties by the People's Court when accepting civil or administrative cases.
Q: How is the filing fee calculated for a 1.5 million RMB property case?
A: According to the progressive bracket rules, it costs approximately 13,300 RMB. The breakdown is: 50 RMB for the portion under 10,000 + 2,250 RMB for the 10,000 to 100,000 portion + 2,000 RMB for the 100,000 to 200,000 portion + 9,000 RMB for the 200,000 to 500,000 portion.
Q: Does the calculated result include attorney fees?
A: This tool only calculates the case filing fee charged by the court. It does not include attorney fees, preservation fees, or other expenses. The final cost is subject to the court's payment notice.
The claim amount should be entered in RMB (Yuan); for divorce cases, you must select whether property division is involved; the calculation results do not apply to Hong Kong, Macau, or Taiwan regions; it is recommended to reserve a 10% buffer for potential fee adjustments.
For property cases with a claim amount exceeding 1 million RMB, filing separate lawsuits may reduce the total cost. Typical example: If a 2 million RMB claim is split into two cases of 1.5 million and 500,000 RMB, the filing fee can drop from 17,800 RMB to 16,300 RMB.
